    PROJECT OVERVIEW

    Southeast Florida Regional Climate Change Compact (SFRCCC) is seeking to hire ScaleWP to redesign its website and content strategy from the ground up to create a modern, interactive design using a WordPress framework that will empower its marketing teams to publish new content.

    APPROACH

    Based on our discussions, we are proposing the following approach to create a more cohesive website design that clearly presents SFRCCC’s mission, value statements, and call to actions. 

    • ScaleWP will work closely with SRFCCC’s graphic designer and, using its new branding, develop a web style guide that sets the tone for the website’s design. This may include working branding elements into the layout design of pages, or different accents throughout the website. 
    • ScaleWP will export the current website and rebuild it in our development environment so that current marketing campaigns can continue and the current site remains live. 
    • ScaleWP will audit existing content to create a wireframe for new pages that do not have a content layout. 
    • ScaleWP will work with the SFRCCC team to create a new theme for the site with a modern, updated redesign of the website’s global user experience and primary pages which will include the home page, global navigation, services pages, and others as defined below. 
    • ScaleWP will redesign the site in a way that displays SFRCCC’s story, mission, and capabilities in an interactive and engaging way. 
    • If needed, CRM integrations will be done using Gravity Forms and the Gravity Forms Zapier addon. ScaleWP will also work with SFRCCC’s existing marketing team to make sure that current campaigns are integrated into the new site build. 
    • We will create a new WordPress child theme based on the designs using the existing Divi premium framework that’s easy to customize and manage.
    • During theme development, ScaleWP will optimize the theme for WCAG 2.0 AA compliance and run a Chrome Lighthouse accessibility scan to gauge accessibility.  This scan score is dependent on the site’s design and content. ScaleWP’s accessibility optimization applies to the site’s WordPress theme only. ScaleWP does not perform accessibility audits but we can contract a third party if needed for an additional fee. An audit may produce a remediation plan that could incur additional development costs that are not covered in this scope.
    • Content (new copy, pdfs, images) will be provided by the client, or ScaleWP can source these images using Adobe Stock when needed. 
    • We may recommend purchasing stock videos to create a video background on the homepage. These generally cost between $25-80 each. 
    • We will provide training for the company staff to update and manage new functionality on the site.

    TIMING
    The site will be complete and ready to launch 60 days after project initiation. Timing is subject to approval and content being provided in a timely manner.


    STATEMENT OF WORK AND ESTIMATES
    Price estimates are based on initial objectives and may change as mutually agreed-upon tasks and objectives change. Cost estimates and payment schedules are provided in three milestones. 

    Total Project Fee:  $23,500

    Milestone 1: Discovery ($2,500)
    We’ll begin work after the Milestone 1 Deposit $2,500 has been paid. 

    • Wireframes & Content Strategy: For new pages or pages that need a completely new layout, ScaleWP will develop wireframes to establish a broad content strategy. 
    • This will include a design and content questionnaire that will help establish the site’s creative direction that we will discuss on a discovery call.
    • Sitemap development: ScaleWP will advise on navigation solutions based on content strategy and wireframe discussion. 
    • Complex app or other tech consultation: We will work with the SFRCCC team to define any technical and content requirements for managing documents, and CRM integrations using Gravity Forms and Zapier. 
    • Project management and communication: 6-8 planning and review calls will occur throughout the project. ScaleWP uses Asana and Slack for project collaboration.
    • Staging and basic theme/plugin setup: Create a staging environment and install all themes and plugins defined in the discovery process. 

    Milestone 2: Design ($7,500)
    We’ll begin work after the Milestone 2 Deposit of $7,500 has been paid. 

    • Unique Figma designs (per page design): Using the wireframes, design questionnaire, new site branding, and our discussion from discovery calls, our team will create Figma designs for the SFRCCC team to review.  This will include up to 10 total Figma designs that will handed off to our development team for the homepage and several primary pages of the website.
    • Design revisions hours included: 3 revision sprints. A revision sprint consists of 1 hour of work. ½ of the total revisions.

    Milestone 3: Theme & site development ($9,500)
    We’ll begin work after the Milestone 3 Deposit of $9,500 has been paid. 

    • Unique page templates: Create custom Divi theme builder templates (Layouts) for approved designs and apply to primary and secondary pages. Primary designs will be applied to microsites.
    • Custom system templates: Develop custom pdf, search, and blog archive pages where needed. 
    • Site chrome: Create advanced secondary menus and menus that have the same overall design but may have some unique elements including up to 3 mega menu dropdowns, if applicable. 
    • Plugin install setup: Includes plugins to enhance document management, security, performance, advanced on-site search, etc.
    • Web and Mobile browser testing: Confirm that the site performs as expected in the most recent versions of Chrome, Safari on the most recent versions of Windows, MacOS, Android and iOS.
    • Complex plugin setup or custom work: ScaleWP will set aside time for any complex plugin setup for functionality such as document/PDF management and CRM integration which includes configuration and testing. 
    • ScaleWP will add the ADA extensions and perform a scan. 
    • Beta site revisions hours included: 3 revision sprints. A revision sprint consists of 1 hour of work. ½ of total revisions.


    Milestone 4: Content development ($2,500)
    We’ll begin work after the Milestone 4 Deposit of $2,500 has been paid. 

    • Create additional pages beyond the home page including internal pages from approved Figma designs. This includes up to 25 pages of existing content. 
    • Blot Setup: Create standard blog posts, blog templates design, search template designs and category template design. 
    • Import and Setup Blog Posts: Import existing posts. ScaleWP will use Divi’s theme builder functionality to automatically redesign these posts into the approved new design.
    • Other data imports
    • Import any forms, documents, etc. 

    Milestone 5: Launch sprint ($1,500)
    We’ll begin work after the Milestone 5 Deposit of $1,500 has been paid. 

    • Stage to live server migration and setup: ScaleWP will migrate the site to the production server and assist with launch steps. These can be either on our fully-managed WordPress hosting platform or another managed WordPress host that is chosen by SFRCCC.     • 301 redirect management: Assist in the creation of 301 redirects for any renamed or moved pages.
    • Site speed optimization: Assist with configuring plugins and assist with the SFRCCC team’s server performance optimization. 
    • Training: Conduct 2-3 video training sessions with the SFRCCC team members.
    • Post-launch revision hours included: Troubleshoot and fix bugs and responsive issues.

Terms

ScaleWP LLC – Terms & Conditions

Payment & Terms:

SCALEWP requires an initial, non-refundable payment of $2,500 upon the initiation of the agreement. Client will be invoiced the Milestone amount at the initiation of each Milestone. Payments may made via credit card and ACH through ScaleWP app, or by check.

Fees may vary +- 10% based on actual requirements to be determined by mutual agreement. Fees are inclusive of expenses, as long as all work required is related to development objectives previously agreed upon. Hosting is not included.

If, upon mutual agreement, additional tasks are required beyond what is covered by the proposal or agreed upon in planning, those additional hours will be billed at our discounted hourly rate of $100/hour. The client will be notified of the expected additional fees in advance of the work being initiated.

Section B: Miscellaneous

This Agreement shall not establish a joint venture or partnership, and neither party may bind the other without the advance written consent of the other party.

Publicity. The parties will cooperate to create public announcements relating to the relationships set forth in this Agreement. Neither party shall make any public announcement regarding the existence of this Agreement without the other partyʼs prior written approval.

Mutual Indemnification. Client will indemnify CM for all claims against CM arising out of activities of Clientsʼ employees and contractors. CM will indemnify Client for all claims against Client and arising out of activities of the employees and contractors of CM. The indemnifying party shall have the right to control the defense, and then the indemnified party shall provide reasonable cooperation for such defense.

“Indemnify” means to pay or reimburse for all damage, loss, cost and expense (including reasonable attorney fees).

Assignment. Neither party may assign this Agreement or delegate their duties without the advance written consent of the other party. No change or modification to this Agreement shall be effective unless signed by the parties. This Agreement constitutes the entire agreement between the parties.

Force Majeure. Neither party shall be in default or otherwise liable for any delay in or failure of its performance under this agreement where such delay or failure of its performance under this agreement arises by reason of any Act of God, or any government or any governmental body, acts of war, the elements, strikes or labor disputes, or other cause beyond the reasonable control of CM.

Governing Law. This agreement shall be governed by the laws of the State of Missouri as to all matters including, without limitation, matters of validity, construction, effect and performance.

Confidentiality. Neither party shall disclose to any third party the Confidential Information of the other party and shall not use any such Confidential Information for any purpose other than the purpose for which it was originally disclosed to the receiving party. Confidential Information means any information of a party disclosed to the other party, which is identified as, or should be reasonably understood to be, confidential to the disclosing party.

Consent. Any consent to be given under this Agreement will not be unreasonably withheld or delayed.

Client Warranties. Client represents and warrants that the Client Properties will not knowingly: (a) violate any law or regulation, including, without limitation, the laws and regulations governing export control; (b) be defamatory or trade libelous; (c) be pornographic or obscene; or (d) contain any viruses, Trojan horses, worms, time bombs or other computer programming devices which are intended to damage a user=s system or data or prevent the user from using same.

Client further represents and warrants that (a) Client has all rights necessary for the production, distribution, exhibition and exploitation of the Client Properties as part of the Work Product consistent with the license granted in this Agreement; and (b) there is no outstanding contract, commitment or agreement to which Client is a party or legal impediment of any kind known to Client which conflicts this Agreement or might limit, restrict or impair the rights granted hereunder.

Client further represents and warrants that ScaleWP has the right to display completed work from the project in announcements and promotions.

DISCLAIMER. THE FOREGOING WARRANTIES BY EACH PARTY ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NEITHER PARTY SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY COVER OR SETOFF NOR FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LIMITATION OF LIABILITY. DEVELOPER’S LIABILITY TO CLIENT FOR ANY REASON AND UPON ANY CAUSE OF ACTION, WHETHER SOUNDING IN TORT, CONTRACT, OR ANY OTHER LEGAL THEORY, SHALL AT ALL TIMES AND IN THE AGGREGATE BE LIMITED TO THE GREATER OF (A) $450, OR (B) THE AMOUNT ACTUALLY PAID BY CLIENT TO DEVELOPER DURING ONE (1) FULL CALENDAR MONTH IMMEDIATELY PRECEDING THE MONTH IN WHICH THE EVENT UPON WHICH LIABILITY IS PREDICATED FOR SERVICES PROVIDED BY DEVELOPER HEREUNDER, EXCLUSIVE OF ANY EXPENSES REIMBURSED PURSUANT THIS AGREEMENT. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED OR IMPLIED HEREIN, DEVELOPER SHALL HAVE NO LIABILITY FOR ANY DAMAGES, WHATSOEVER RELATING TO THE TOOLS, THIRD PARTY PRODUCTS, OR ANY GOODS OR SERVICES NOT DEVELOPED OR PROVIDED BY DEVELOPER.
