    PROJECT OVERVIEW

    Speedy’s C-Stores is seeking to hire ScaleWP to redesign its website to create a more modern design using a WordPress framework that will empower its marketing teams to publish new content and serve as a platform for new offerings and services.

    APPROACH

    We are proposing the following approach :

    • ScaleWP will help develop a web style guide, user interface and other creative elements that set the tone for the design of the website. Existing logos provided by client will be used.
    • ScaleWP will work with the client team to create a new WordPress theme for the site with a modern, updated redesign of the website’s global user experience and primary pages which will include the home page, global navigation, news/blog pages, Locations, Gas Cards, Coupons, Delivery and Careers. 
    • We will create a new WordPress child theme using the  Divi premium framework that’s easy to customize and manage by the marketing team.
    • Content (video, promotional copy, pdfs, images) will be provided by the client. Scalewp will assist with branding and positioning copy. Optionally, ScaleWP can source copy and images when needed for additional licensing fees and hours to be invoiced at $85/hr.
    • Integration include a possible zapier/api integration for forms submitted for career applications and integrating the links for 3rd party delivery services. 
    • We will provide training for the client team to update and manage new functionality on the site.

    TIMING
    The site will be complete and ready to launch 60 days after project initiation. Timing is subject to approval and content being provided in a timely manner.


    STATEMENT OF WORK AND ESTIMATES

    Price estimates are based on initial objectives and may change as mutually agreed-upon tasks and objectives change. Cost estimates and payment schedules are provided for three milestones. 

    Total Project Fee:  $15,500 

    Milestone 1: Discovery, Scope of Work and Initial Design 

    $3,875 due at the initiation of Milestone 1.

    Weeks 1-4 

    • Meet to discuss Design, Branding, Promotion, Content and navigation requirements. 
    • ScaleWP will take these requirements to create a web style guide document that will define the typography, colors, and overall style of the website. 
    • ScaleWP will create low-fidelity, web-based wireframes based on content and general direction provided by the the client team. 
    • Meet/call, revise and review the wireframe drafts based on feedback from the client team.
    • Once these wireframes are approved ScaleWP will begin creating finalized Figma designs with the following deliverables:
      • The homepage with clear calls to action and similar to presentation on https://wawa.com/
      • A locations main page with Google powered map and location awareness for the user.
      • An individual location page with services and contact info at that location.
      • A Delivery page integrating with delivery services TBD.
      • A Careers page with form to collect submissions and a system to securely mange information
      • A new Car Wash page to promote the service. Possible app integration in phase 2.
      • 1 News page grid page
      • 1 Individual News Post design
    • Included in the Home page design draft will be the overall site Chrome (Branding, navigation, and footer). 
    • Meet/call, revise and review the Figma design drafts based on feedback from the client team.
    • Complete one round of revisions with up 5 hours of work on Figma designs.

    Milestone 2: Site Development, Internal Page Design, Content Development

    $3,875 due at the initiation of Milestone 2.

    Weeks 4-6

    • Create a development server and install ScaleWP’s WordPress framework and the Divi theme. 
    • Migrate wireframe pages to the development environment and provide access to the client team so they can begin adding written content.  
    • Review site plugins, and install and configure any additional plug-ins to add functionality defined in the discovery phase. Remove/replace unused or outdated plugins. 
    • Customize and configure the theme, user experience and content organization based on the approved design drafts. Actual website design will vary based on screen size and platform and will not look exactly the same for all users on all platforms.
    • Create Divi Layout templates for the new page designs created in Milestone 1. Apply the layouts to the pages. 
    • Modify images for headers and primary pages in order to be rendered correctly across all screen sizes. 
    • Deliverable: Beta website with up to 10 total custom designed pages and 10-15 standard content pages delivered to the client team for feedback.


    Milestone 3: Site Build-out, Final Deliverable

    $3,875 due at the initiation of Milestone 3.

    Weeks 6-8

    • Complete 1 revision round based on the feedback from the client team with up to 5 hours of total work. 
    • ScaleWP team will buildout additional 3-5 posts and 3-5 portfolio pages for launch.
    • Test site on the latest versions of Chrome, MSFT IE/Edge, Firefox, Safari. Test on most recent versions of Android and iOS. Make revisions as needed.
    • Configure up to 20 301 redirects if existing pages have new permalinks.
    • Analyze and optimize site performance.


    Milestone 4: Launch, Training and Bug Fixes

    Final $3,875 will be invoiced at site launch, when DNS is changed to point to the new website.

    • Assist with Launch: Launch timing, admin accounts setup, broken link checking and DNS changes
    • Post-launch checks and integrations. Confirm: emails are delivering, emails services are connected (eg Mailchimp) and Google analytics is pulling data.
    • Train client team to manage the site, including up to 2 hours of virtual meetings. 
    • Within 30 days of launch, fix and test any bugs or issues with the functionality defined in the Discovery phase.

Terms

ScaleWP LLC – Terms & Conditions

Payment & Terms:

SCALEWP requires an initial, non-refundable payment of $3,875 upon the initiation of the agreement. Client will be invoiced $3,875 at the initiation of Milestone 2 and Milestone 3. The final invoice for $3,875 will be invoiced at site launch. Payments may made via credit card and ACH through ScaleWP app, or by check.

Fees may vary +- 10% based on actual requirements to be determined by mutual agreement. Fees are inclusive of expenses, as long as all work required is related to development objectives previously agreed upon. Hosting is not included.

If, upon mutual agreement, additional tasks are required beyond what is covered by the proposal or agreed upon in planning, those additional hours will be billed at our discounted hourly rate of $85/hour. The client will be notified of the expected additional fees in advance of the work being initiated.

Section B: Miscellaneous

This Agreement shall not establish a joint venture or partnership, and neither party may bind the other without the advance written consent of the other party.

Publicity. The parties will cooperate to create public announcements relating to the relationships set forth in this Agreement. Neither party shall make any public announcement regarding the existence of this Agreement without the other partyʼs prior written approval.

Mutual Indemnification. Client will indemnify CM for all claims against CM arising out of activities of Clientsʼ employees and contractors. CM will indemnify Client for all claims against Client and arising out of activities of the employees and contractors of CM. The indemnifying party shall have the right to control the defense, and then the indemnified party shall provide reasonable cooperation for such defense.

“Indemnify” means to pay or reimburse for all damage, loss, cost and expense (including reasonable attorney fees).

Assignment. Neither party may assign this Agreement or delegate their duties without the advance written consent of the other party. No change or modification to this Agreement shall be effective unless signed by the parties. This Agreement constitutes the entire agreement between the parties.

Force Majeure. Neither party shall be in default or otherwise liable for any delay in or failure of its performance under this agreement where such delay or failure of its performance under this agreement arises by reason of any Act of God, or any government or any governmental body, acts of war, the elements, strikes or labor disputes, or other cause beyond the reasonable control of CM.

Governing Law. This agreement shall be governed by the laws of the State of Missouri as to all matters including, without limitation, matters of validity, construction, effect and performance.

Confidentiality. Neither party shall disclose to any third party the Confidential Information of the other party and shall not use any such Confidential Information for any purpose other than the purpose for which it was originally disclosed to the receiving party. Confidential Information means any information of a party disclosed to the other party, which is identified as, or should be reasonably understood to be, confidential to the disclosing party.

Consent. Any consent to be given under this Agreement will not be unreasonably withheld or delayed.

Client Warranties. Client represents and warrants that the Client Properties will not knowingly: (a) violate any law or regulation, including, without limitation, the laws and regulations governing export control; (b) be defamatory or trade libelous; (c) be pornographic or obscene; or (d) contain any viruses, Trojan horses, worms, time bombs or other computer programming devices which are intended to damage a user=s system or data or prevent the user from using same.

Client further represents and warrants that (a) Client has all rights necessary for the production, distribution, exhibition and exploitation of the Client Properties as part of the Work Product consistent with the license granted in this Agreement; and (b) there is no outstanding contract, commitment or agreement to which Client is a party or legal impediment of any kind known to Client which conflicts this Agreement or might limit, restrict or impair the rights granted hereunder.

Client further represents and warrants that ScaleWP has the right to display completed work from the project in announcements and promotions.

DISCLAIMER. THE FOREGOING WARRANTIES BY EACH PARTY ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NEITHER PARTY SHALL HAVE ANY LIABILITY WHATSOEVER FOR ANY COVER OR SETOFF NOR FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LIMITATION OF LIABILITY. DEVELOPER’S LIABILITY TO CLIENT FOR ANY REASON AND UPON ANY CAUSE OF ACTION, WHETHER SOUNDING IN TORT, CONTRACT, OR ANY OTHER LEGAL THEORY, SHALL AT ALL TIMES AND IN THE AGGREGATE BE LIMITED TO THE GREATER OF (A) $450, OR (B) THE AMOUNT ACTUALLY PAID BY CLIENT TO DEVELOPER DURING ONE (1) FULL CALENDAR MONTH IMMEDIATELY PRECEDING THE MONTH IN WHICH THE EVENT UPON WHICH LIABILITY IS PREDICATED FOR SERVICES PROVIDED BY DEVELOPER HEREUNDER, EXCLUSIVE OF ANY EXPENSES REIMBURSED PURSUANT THIS AGREEMENT. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED OR IMPLIED HEREIN, DEVELOPER SHALL HAVE NO LIABILITY FOR ANY DAMAGES, WHATSOEVER RELATING TO THE TOOLS, THIRD PARTY PRODUCTS, OR ANY GOODS OR SERVICES NOT DEVELOPED OR PROVIDED BY DEVELOPER.
